a two-day showdown over same- sex marriage started today in washington. and tomorrow is day two. when the u.s. supreme court will hear arguments on the defense of marriage act. today. the high court heard oral arguments on proposition 8. approved by california voters. it banned same-sex marriage in the golden state. after courts had previously ruled those marriages were legal. as expected. the court seemed divided on the issue today. >> "if they're a class that makes any other discrimination improper, irrational, then why aren't we treating them as a class for this one thing?"/"you want us to step in and render a decision based on an assessment of the effects of this institution which is newer than cell phones or the internet?" >> lawyers representing the
plaintiffs -- two unmarried same-sex couples -- stated their case. while on the other side. lawyers the prop 8 marriage ban spoke. >> "they are labeling their most cherished relationships as second rate, different, unequal, and not okay."/ "we believe that prop 8 is constitutional and we believe the place for the decition to be made about redefining marriage is with the people." >> even the justices questioned whether the court should be hearing the case at all. and whether the backers of prop 8 have the legal standing to appeal the ruling in the first place. >> a decision from the court is expected in june. new tonight at 8.we spoke with john lewis and stuart gaffney, a couple from san francisco that married back in 2008 while it was briefly legal in california. they traveled to washington, d-c for the hearings. they have been outspoken advocates of marriage equality for years. and while they hope the

>> the manhunt is on for the person who shot and killed a woman in west oakland earlier today. this is video from our helicopter partnership with abc 7 news. it shows the shooting scene which all happened in broad daylight. outside a family market on 12th street near peralta. police say, the woman was walking, when a man approached her and fired multiple shots at her. police are reviewing the stores surveillance video, and say, the motive is unknown at this time. this is oakland's 19th homicide of the year. >> a man is dead after he was found on fire.on a pedestrian overpass this morning in napa. police received the call just before four a-m, about a fire on a trail just over highway -29 near trancas. police say, the death is being investigated as a homicide but believe it might be a suicide. no word on the victim's idenity. >> an 8 year old girl who was shot by an arrow outside a u-c berkeley science center is recovering in the hospital tonight.

accident. >> she was crying a little bit. one of the adults was comforting her. >> i felt horrible for her but she felt so she seemed subdued. she had a little sunglasses. >> it was an idiot not paying attention or maybe it was somebody malicious. >> j.r. stone, kron 4 news. >> pam: released a sketch of the woman. who kidnapped an 11-month old baby. this is that sketch. police say. the woman stole a jeep on amador court around 6:30 yesterday morning. there was an 11- month old baby in the back seat. they say, the suspect is hispanic, in her late thirties or early forties. and about five -feet -five inches tall. the baby was found around noon yesterday in the abandoned s-u-v. the san jose police were tipped off about the stolen jeep and officers
responded. the baby was safely taken into a hosptial yesterday.where shortly afterward-was reunited with her mother. >> the morgan hill pre- school teacher. accused of drugging at least five students, in order to get them to take a nap, pleaded not guilty today in court. debbie gratz is facing 10 - counts of child endangerment and assault. there were a number angry parents in attendance during the hearing. they are worried about the long- term health effects their children face, after being drugged. meredith kercher was killed in 2007. knox and her former italian boyfriend were first convicted - and then acquitted - of kercher's death. knox has been back home in seattle since 20-11.and apparently does 'not' plan to be at the new trial, not surprisingly. it's not absolutely clear whether she'd be extradited to italy if she's again convicted. one of her attorneys says knox is "shocked and saddened - but ready to fight." the problem hasent quite gone away yes. some slow down, or as we call it the hollywood stop but for it to be a full stop the bus must cease all forward motion. this is b street where buses cross these double set of tracks to go to the bart station, even greyhound buses travels this route and apparently they don't come to a complete stop either over on tennyson, it more of the same ac transit bus drivers failing to come to a complete stop which is state law i know for a fact that this behavior is heavely frowned upon by ac transit management however it still continues in all cases the drivers put on their hazards alerting drivers they are about to stop but no actual stop and over on hesperion is was the same problem, i was told that after my last look at the buses the habits had changed but if i were to return a few months later it was be business as usual . they were right now to be fair some bus drivers did stop but the majority jusr rolled across the tracks in hayward stanley roberts kron 4 news
